Terms and Conditions for Online Purchases of BrodzikArt Kornelia Brodzik Products
The following terms and conditions govern the rules for placing Orders at BrodzikArt Kornelia Brodzik, operating at: www.brodzikart.com
Definitions
Whenever the terms and conditions mention:
- Seller – this means the company:BrodzikArt Kornelia Brodzik

NIP: 8392985896 - Customer – this means a natural person (with at least limited legal capacity and at least 18 years of age), as well as a legal person or an organizational unit without legal personality, with legal capacity and the ability to perform legal acts.
- "Store" – means the online store operated by the Seller at www.brodzikart.com.
- "Goods" – means the goods offered by the Seller for retail sale in the Store, as well as goods made to individual customer orders.
- "Price" – means the gross price of the Goods placed next to the information about the Goods. Shipping costs are included in the price of the Goods. The prices of the Goods in the Store are expressed in Polish zloty and include VAT applicable to sellers in Poland. Prices do not include taxes and customs duties applicable in countries outside Poland. Tax and customs duties applicable in a given country are borne by the customer.
- "Delivery" – means the courier company listed in the Store cooperating with the Seller or other persons authorized by the Seller to deliver the Goods.
- "Goods Delivery Costs" – means the costs incurred to package and deliver the Goods to the Customer in accordance with the Order placed by the Customer. These costs are included in the price of the painting.
- Order – this shall be understood as a set of Goods specified for execution, in accordance with these Regulations, by the Customer in electronic form.
Acceptance and Processing of Orders
- The Store sells goods online. The Store provides information about its offerings at www.brodzikart.com.
- The basic condition for the fulfillment of purchases is the correct completion by the Customer of the order form available on the Store's website.
- The Customer is solely responsible for any consequences resulting from incorrect or inconsistent placement of an Order by the Customer in accordance with the Terms and Conditions, incorrect data provided in the registration form, or an incorrect delivery address.
- Orders from Customers are accepted via the website www.brodzikart.com. After placing an order, the Customer will receive an email confirming that the Store has received the order and has accepted or rejected it.
- The Store reserves the right to refuse to process orders in the event of an incorrectly completed order form or lack of order confirmation.
- A confirmed order will be fulfilled:
- in the case of orders paid by bank transfer - after payment has been credited to the Seller's account;
- The Seller does not accept cash on delivery payments.
- Order processing time for products available in the store is up to 30 business days. The processing time for individual orders, meaning a custom-painted painting, is agreed upon in a private message and depends on the amount of work required to complete the order. It can range from 12 to 24 months. If some of the items included in the order are unavailable, the Customer is informed of the order status and decides how to fulfill it (partial fulfillment or cancellation of the entire order).
- The Store selects the delivery method.
- Shipping costs are covered by the Store.
- Estimated delivery time is up to 30 days. In Poland, Europe, and worldwide. The price does not include customs duties and taxes applicable in a given country. These fees are covered by the Customer.
- Orders for available goods are shipped within POLAND, to countries within the European Union and to countries outside the European Union, to all countries on every continent, provided that the situation in a given country allows for safe and sustainable parcel transport.
- The cost of an individual order is determined individually and includes shipping costs.
- Purchased goods are delivered to the address indicated in the order form.
- By placing an order in the Store, the Customer consents to the storage of their personal data in the BrodzikArt Kornelia Brodzik database and to their processing for the purposes of fulfilling the contract. Providing personal data by the Customer and consenting to their processing are necessary for the Store to fulfill the order. The Customer is responsible for providing false personal data. Personal data is protected in accordance with the Personal Data Protection Act of August 29, 1997 (Journal of Laws No. 133, item 883) in a way that prevents access by third parties.
- The Customer consents to receiving Store promotional materials via email and traditional mail.
Goods Prices
- Prices in the online store are quoted in Polish zloty, euros, and dollars and include VAT applicable in Poland. The price given for each product is binding at the time the Buyer places an order. The store reserves the right to change the prices of goods on offer, introduce new products to the store's offerings, conduct and cancel promotional campaigns on the store's website, or make changes to them.
- The final price payable by the Buyer is the sum of the prices of the purchased goods.
- A limited number of goods are designated for promotional sales and clearance sales, and orders are fulfilled in the order in which confirmed orders for these goods are received, until stocks covered by this form of sale are exhausted.
- Discounts and promotions offered in the store cannot be combined.
Warranties and Complaints
- Each complaint is considered individually.
- Upon receipt of the parcel, the Customer is obligated to check for damage. In the event of any damage, the Customer is obligated to open the parcel in the presence of the postman or courier and check whether the goods ordered by the Customer have not been damaged during transport. If the products are damaged or crumpled, the Customer is obligated to complete a complaint report in the presence of the delivery person (refusing to accept the parcel and citing damage to the contents by the delivery person). In this case, this will be the basis for the Store to file a complaint with the carrier.
- The Customer has the right to withdraw from the contract without giving a reason within 14 days of receipt of the parcel. This provision does not apply to custom orders, where the painting is painted or drawn to a special, individual order.
- The Store will only accept returns if the product has not been tampered with in any way. The product must not show any signs of use: it must not have been opened, damaged, tried on, or missing its original packaging.
- The cost of packaging and returning the product is borne by the Customer.
- The product returned by the Customer should be secured so as to prevent damage – the Store should receive the product in the same condition in which it was sent – only then will the return be accepted.
- The Store stipulates that it does not accept cash on delivery shipments.
- If the return is approved, the money will be transferred to the Customer via bank transfer.
- All complaints will be considered no later than 14 days from the date the Store receives the shipment with the complained goods. Damaged goods will be replaced with another, full-value, similar product, agreed with the Customer. If this is no longer possible (for example, due to depletion of stock), the Store will refund the buyer the equivalent of the product price or offer them other goods available in the Store to choose from. Each product made by BrodzikArt Kornelia Brodzik is unique. Exchanges for identical products are not possible.
- Products shown in the photos (shape, packaging size, etc.) may differ slightly from the products ordered, and these differences cannot be grounds for a complaint.
Custom Orders
A custom-made painting or drawing is based on a high-quality photograph sent by email to artbrodzik@gmail.com.
Details of the painting, dimensions, and colors are discussed with the client before the painting or drawing begins. Before the order is processed, the client submits a deposit of 50% of the total order price to the Store's bank account. Once the payment is credited to the Store's account, the order is processed. The Store remains in contact with the client throughout the process. After the painting is completed, the Store sends a photograph for client approval.
At the client's request, the Store may change the order details if technically feasible, taking into account all possible painting techniques. This assessment is made by the owner of BrodzikArt, Kornelia Brodzik. After the painting is completed and the payment is received, the Store ships the painting to the address provided by the client.
Final Provisions
- The information contained on the store's website does not constitute an offer within the meaning of the Civil Code. It constitutes an invitation for Customers to submit offers.
- In all matters not regulated by these Terms and Conditions, the provisions of the Civil Code and other acts shall apply. With respect to consumers, the Act of 2 March 2000 on the protection of certain consumer rights and on liability for damage caused by a dangerous product (Journal of Laws No. 22 item 271, as amended) and the Act of 27 July 2002 on specific terms and conditions of consumer sales and amending the Civil Code (Journal of Laws No. 141 item 1176) shall also apply.
- Brodzikart Kornelia Brodzik E-Shop reserves the right to amend these Terms and Conditions.
